Client Terms and Conditions

Effective January 15, 2026

 

These Client Service Terms and Conditions ("this Agreement") establishes the relationship between Kior Travel LLC ("Company," "we," "our") and the individual or entity engaging our services ("Client," "you," "your"). Collectively, the parties are referred to as "Parties."

 

AGREEMENT FORMATION AND DURATION

​

This Agreement becomes legally binding when you take any of the following actions: submitting a signed copy of this Agreement, making any payment toward travel arrangements, or proceeding with any reservation we coordinate on your behalf.

 

Once formed, this Agreement continues until either Party provides written notice of termination to the other.

​

We retain the right to update these terms periodically. Significant changes affecting your rights, our liability, pricing structures, or cancellation policies will be communicated via email or postal mail no fewer than thirty days before implementation. Minor administrative clarifications take effect immediately upon posting to our website. Continued engagement with our services following any update constitutes your acceptance of modified terms.

 

KEY TERMINOLOGY

​

Throughout this Agreement, the following terms carry specific meanings:

 

A Reservation refers to any booking, confirmation, or arrangement we secure with third-party providers on your behalf.

​

A Supplier means any airline, hotel, tour operator, cruise line, transportation company, villa owner, yacht charter operator, experience provider, or other entity that delivers travel-related products or experiences.

​

A Traveler includes you and any individual traveling under the same Reservation.

​

Travel Arrangements encompasses all products and experiences delivered by Suppliers, including but not limited to flights, accommodations, ground transportation, guided experiences, meals, and entertainment.

​

A Trip describes the complete collection of Travel Arrangements comprising your travel experience.

​

Trip Documentation refers to all confirmations, itineraries, invoices, schedules, pricing summaries, and other documentation we provide regarding your Trip. Where Trip Documentation conflicts, the itinerary governs inclusions and the invoice governs pricing.

​

Membership refers to any annual travel planning or relocation package purchased from Kior Travel, entitling the holder to specified services during the membership term.

 

CLIENT RESPONSIBILITIES

​

By engaging our services, each Traveler commits to the following obligations:

​

Review all materials thoroughly. You must carefully examine this Agreement, your Trip Documentation, and all communications concerning your Trip. You agree to notify Kior Travel in writing within forty-eight (48) hours of receipt of any errors, omissions, or discrepancies. If you fail to notify us within this period, you waive any claim against Kior Travel arising from the error, you are responsible for any additional costs required to correct the error, and correction may not be possible if Supplier deadlines have passed.

​

Plan ahead. Contact us with sufficient lead time to secure availability, minimize additional fees, and avoid price escalations that occur as departure dates approach.

​

Meet payment deadlines. Submit all deposits and balances according to the schedule outlined in your Trip Documentation. Missed payments may result in cancellation of your booking.

​

Stay informed about travel conditions. Regularly consult official government resources, including the CDC (cdc.gov) and State Department (travel.state.gov), for current advisories, health requirements, and entry restrictions affecting your destinations. We provide guidance, but you are ultimately responsible for ensuring you meet all requirements for your Trip.

​

Obtain required documentation. Each Traveler must hold a valid passport and is responsible for ensuring passport validity for the destination, including any required remaining validity period. Upon registration, you must provide a copy of your passport photo page. If requested, an updated copy must be provided no later than ninety (90) days before departure. If a visa is required, you are solely responsible for obtaining it in time for travel. Failure to secure required documents is treated as a Traveler cancellation and will be subject to the cancellation terms in this Agreement and any applicable Trip-specific disclosure.

​

By accepting this Agreement, you confirm that you are at least eighteen years old and possess legal authority to bind all Travelers listed on your Reservation, including any minors residing in your household.

 

WHAT IS INCLUDED AND EXCLUDED

​

Your Trip includes only the components expressly confirmed in your Trip Documentation. If an item is not expressly listed as included, it is not included.

​

Inclusions may comprise, where specified: accommodation for confirmed Trip dates, meals expressly listed, activities and experiences expressly listed, ground transportation and transfers expressly listed, entrance fees and permits expressly listed, and gratuities expressly listed with recipient specified.

​

Unless expressly included in your Trip Documentation, the following are excluded: international and domestic flights, visa and entry fees, travel insurance, transportation to and from Trip meeting or departure points, pre- or post-Trip accommodation, optional activities offered during the Trip, gratuities not expressly listed, personal expenses, minibar and room incidentals, personal equipment and clothing, trip planning or itinerary customization services beyond what is reflected in your confirmed Trip Documentation, and any costs arising from circumstances beyond our reasonable control.

​

Optional services may be available for an additional fee upon request, including equipment rental, additional trip planning or customization, pre- or post-Trip accommodation, airport transfers outside standard Trip dates, travel insurance coordination, and optional activities or excursions. Availability and pricing for optional services are not guaranteed and must be confirmed in writing before departure.

 

SUPPLIER RELATIONSHIPS

​

The airlines, hotels, tour operators, and other entities delivering your Travel Arrangements operate independently from our Company. They maintain separate ownership, management, and operational control. They do not serve as our employees, agents, or representatives.

​

Our role is to facilitate Reservations and communicate your preferences. We exercise reasonable care in selecting reputable Suppliers but do not own, operate, or control Supplier services. We are not liable for any Supplier's acts, omissions, breaches, delays, cancellations, schedule or route changes, pricing practices, regulatory violations, or failures to deliver services as described—except where such failure results from Kior Travel's own negligence or willful misconduct.

​

Each Supplier maintains its own contractual terms governing the services they deliver. Those terms—not this Agreement, control your relationship with them. When you pay for Travel Arrangements, you acknowledge and accept engagement with those Suppliers under their respective policies. All tickets, prices, availability, confirmations, and documentation are subject to Supplier terms and may change without prior notice until full payment is made.

​

You bear responsibility for comprehending and following each Supplier's rules and requirements, including payment schedules, baggage policies, timing requirements, and any age, health, or capability restrictions. Direct questions about specific Supplier policies to that provider.

Violating Supplier terms may result in denied service, cancelled Reservations, and forfeiture of payments. If your violation generates costs for our Company, you agree to reimburse us promptly.

If any Supplier enters bankruptcy or ceases operations, they may be unable to deliver promised services or process refunds. Alternative providers may or may not step in to assist. We cannot issue refunds on behalf of financially distressed Suppliers, and we possess no special insight into any Supplier's financial health.

​

All claims arising from Supplier services must be directed to the applicable Supplier. Kior Travel will provide reasonable assistance in communicating with Suppliers regarding complaints or claims but is not obligated to advance funds or guarantee any particular outcome.

 

TRAVEL INSURANCE

​

Kior Travel is not an insurance provider. We advise travelers of the availability of travel insurance, which third-party insurance agents and providers offer to travelers in exchange for fees. We may suggest travel insurance providers upon request but do not endorse or guarantee the services or coverage of these providers.

​

Travel insurance is strongly recommended. This can help prevent needless loss in case of serious illness, accident, or death of the Traveler, Traveler's immediate family, or traveling companion.

Each Traveler must obtain comprehensive travel insurance within fourteen (14) days of paying the initial deposit. Coverage must include, at minimum: trip cancellation and interruption, emergency medical treatment with a minimum limit of $50,000, and emergency medical evacuation.

​

Traveler must provide proof of insurance to Kior Travel within fourteen (14) days of booking. If proof is not received within this period, Kior Travel may, at its discretion: obtain basic travel insurance on Traveler's behalf and charge the cost to Traveler's payment method on file, or treat the booking as cancelled by Traveler subject to cancellation terms.

​

Waiver of Insurance Requirement. If Traveler elects not to obtain travel insurance despite this requirement, Traveler must sign a separate Insurance Waiver acknowledging that Traveler assumes all financial risk of trip cancellation, interruption, medical emergencies, and evacuation; Traveler waives any claim against Kior Travel for losses that would have been covered by insurance; and Traveler remains fully responsible for all amounts due under these Terms regardless of circumstances.

​

If you obtain insurance, understand that policies cover only what they explicitly state. Read all terms carefully. Coverage may contain limitations based on travel type, destination, purchase timing, pre-existing health conditions, or excluded activities.

You release and agree to defend our Company, its principals, staff, and representatives from any claims arising from your insurance decisions—whether to purchase, which policy to select, or claims your insurer denies.

This provision remains effective after Agreement termination.

 

PRICING AND COSTS

​

Prices quoted reflect only the specific items detailed in your Trip Documentation.

​

Unless explicitly included, quoted prices exclude: government taxes and fees; airport, port, or terminal charges; security and customs assessments; passport and visa expenses; gratuities not expressly listed; personal purchases; alcoholic beverages; telecommunications; medical services; travel between airports and accommodations; optional activities; and similar incidental costs.

​

Prices may change. All Supplier pricing remains subject to modification until you complete full payment. Even after payment, you agree to cover variable costs outside our control, such as currency fluctuations or government-imposed taxes, fees, or levies. For group Trips, pricing may also be adjusted as described in the Group Travel Considerations section of this Agreement.

​

Currency adjustments. Trip pricing is denominated in U.S. Dollars. Traveler bears all risk of currency fluctuation between their local currency and the U.S. Dollar. Kior Travel will not adjust pricing based on exchange rate movements, and no refunds or credits will be issued due to currency fluctuations.

We reserve authority to correct pricing errors, issue revised invoices, and adjust Reservations accordingly at any time.

​

We bear no responsibility for third-party pricing practices or foreign transaction fees.

 

GROUP TRAVEL CONSIDERATIONS

​

Group pricing reflects the number of confirmed Travelers. If that number decreases through cancellation, no-show, or removal, the per-person costs may increase, or we may adjust included services to maintain pricing stability.

​

For group Trips, pricing is typically based on a minimum number of confirmed Travelers as specified in your Trip Documentation. If the number of confirmed Travelers falls below this minimum due to cancellations, no-shows, or removals, Kior Travel may, at its discretion: proceed with the Trip at an adjusted per-person rate not to exceed fifteen percent (15%) above the original quoted price; modify inclusions to maintain the original per-person price, with notice of specific changes provided to remaining Travelers; or cancel the Trip.

​

If Kior Travel elects to increase pricing or materially reduce inclusions, remaining Travelers will receive written notice at least sixty (60) days before departure specifying the change. Travelers who do not accept the change may cancel within seven (7) days of notice and receive a refund of amounts paid to Kior Travel, minus any non-recoverable Supplier costs. Substitution of Suppliers or activities of comparable type and quality does not constitute a material reduction. Once Suppliers are confirmed, deposits and fees become non-refundable unless their terms explicitly state otherwise.

​

If one person coordinates group Reservations on others' behalf, that Lead Traveler warrants authority to act for all Travelers and accepts responsibility for ensuring group-wide compliance with this Agreement and all Supplier requirements.

​

When any Traveler cancels or fails to appear, resulting cost increases are distributed among remaining Travelers. We do not absorb costs created by Traveler dropouts.

 

PAYMENT TERMS

​

All payments are denominated in U.S. dollars and must be made in U.S. dollars. Payment methods accepted include debit card, credit card, bank transfer, and wire transfer.

​

You agree to remit all amounts by deadlines specified in your Trip Documentation. If payment is not received by a due date, Suppliers may impose fees, penalties, or cancel the booking; Kior Travel may cancel the booking; and amounts already paid may become non-refundable under Supplier terms.

​

Traveler authorizes charges to the payment method on file as provided in any separate Credit Card Authorization Form.

​

We bear no liability for consequences of payment delays or failures.

​

Payment processing methods. Depending on your Trip, you may pay Suppliers directly, or we may process payments on your behalf and transmit funds to Suppliers. Your Trip Documentation specifies which method applies. When we process payments, we act as intermediary only, not as the entity responsible for delivering Travel Arrangements.

 

CREDIT AND DEBIT CARD AUTHORIZATION

​

By providing card details, you confirm authorization to use that payment method and approve charges on scheduled dates. You authorize correction of erroneous charges via credit to your account.

​

You bear responsibility for providing accurate card information, maintaining sufficient funds, and keeping accounts active through final payment. Card problems such as, but not limited to, declines, expirations, or closures may result in Reservation suspension or cancellation without refund obligation on our part.

 

MODIFICATIONS, CANCELLATIONS, AND REFUNDS

​

Supplier terms apply to all modifications and cancellations. Many Trip components are governed by third-party Supplier policies. Where Supplier terms are more restrictive than this Agreement or any Trip-specific disclosure, Supplier terms control.

​

Planning Fee. The planning fee specified in your Trip Documentation is non-refundable. If you paid your planning fee using a Kior Travel gift card and you cancel before departure, the planning fee amount may be converted to trip credit for a future Trip, at Kior Travel's discretion. This conversion is permitted once only. If you cancel a subsequent Trip, the planning fee is forfeited entirely; any remaining amounts paid beyond the planning fee may be applied as trip credit for future Trips.

​

Gift Cards and Trip Credits. Gift cards expire twelve (12) months from the date of purchase. Trip credits expire on the same date as the gift card from which they originated, or twelve (12) months from the date issued if no gift card was used.

​

Cancellation by Traveler. If written cancellation is received within thirty (30) days of deposit receipt, Traveler may receive a refund of amounts paid minus the non-refundable planning fee and any non-refundable Supplier commitments already made. If written cancellation is received more than thirty (30) days after deposit receipt, Kior Travel may charge a cancellation fee of up to $100 at its discretion, in addition to forfeiture of the planning fee. Any amounts recovered beyond the planning fee, cancellation fee, and non-refundable Supplier costs may be returned to Traveler as a refund or applied as trip credit, at Traveler's election. If Kior Travel recovers any amounts from Suppliers after cancellation, Kior Travel may, in its sole discretion, pass through recovered amounts to Traveler, minus a fifteen percent (15%) administrative fee. Kior Travel is not obligated to pursue refunds from Suppliers on Traveler's behalf after cancellation.

​

Late Payments. You agree to make full payment including deposits and any other amounts due as specified in your Trip Documentation. If any payment is not received in full by the due date, Kior Travel may charge a late fee of up to $100 at its discretion. Additionally, Suppliers may impose their own fees, penalties, price increases, or cancel the booking. Any amounts already paid may become non-refundable in accordance with Supplier terms and conditions. Kior Travel reserves the right to cancel bookings at any time due to late or missed payments or other breaches of agreed terms.

Transfers. Transfers are permitted up to ninety (90) days before Trip commencement at no additional transfer fee, though Supplier fees may still apply. Transfers between ninety (90) and sixty (60) days before commencement may be subject to Supplier fees. No transfers are permitted within sixty (60) days of commencement.

 

Trip Cancellation by Kior Travel. Kior Travel reserves the right to modify or cancel any Booking or Trip at any time if Supplier minimum occupancy requirements are not met. If Kior Travel cancels a Trip, Travelers will be notified promptly and will receive a refund of payments made to Kior Travel, minus any non-recoverable Supplier costs already incurred where applicable. Kior Travel is not responsible for expenses incurred by Travelers in preparing for a cancelled Trip or any independent bookings made outside Kior Travel, which may be non-refundable.

​

Refund claims must be submitted in writing with complete documentation including payment evidence, background explanation, and supporting materials.

​

This provision remains effective after Agreement termination.

 

NAME CHANGES AND OTHER CHANGES

​

Name changes and transfer requests may be subject to Supplier rules and deadlines. A $100 per-person administrative fee applies for name changes or transfers, waived for Kior Travel Membership holders, unless Supplier rules impose additional fees. Name changes are generally only available up to sixty (60) days prior to travel or as Supplier rules permit.

​

Other changes such as room changes or transfer changes may be requested up to ninety (90) days prior without additional Kior Travel fees, subject to Supplier rules and availability.

 

FAILURE TO APPEAR

​

Missing any confirmed Reservation without cancellation constitutes a no-show. No-shows trigger our administrative fees plus any Supplier penalties, potentially including total forfeiture of payments. You agree to pay all resulting charges.

 

ACCOMMODATIONS

​

Room availability depends on conditions at reservation time and check-in. Some properties require non-refundable, non-transferable deposits. We will notify you when such pre-payments are required.

​

Accommodation is included for the official Trip dates only. Early arrivals and extended stays are the Traveler's responsibility, including any lodging, meals, and other expenses incurred during the extended period.

​

For individual Trips, Travelers select their preferred room type at the time of booking. Room preferences may be modified in accordance with the Name Changes and Other Changes section of this Agreement.

​

For group Trips, shared rooms may be offered but are not guaranteed and are subject to availability and early booking. Travelers wishing to secure a specific room type should make their request at the time of booking or within any timeframe specified by Kior Travel. Failure to request a room preference within the specified period may result in the Traveler being placed in standard single accommodations by default.

​

Specific amenities, including but not limited to, room configuration, accessibility features, facility access—cannot be guaranteed across all properties and may be unavailable or non-operational during your stay. Amenity-related refund requests must be directed to the relevant Supplier.

​

Incidentals and damages. Should a Traveler opt to use room service, hotel amenities, or incur any hotel incidentals, damages, or additional unpaid charges, they are solely the Traveler's responsibility to settle before departure. If Kior Travel is charged by a Supplier for unpaid incidentals, damages, or fees attributable to Traveler, Traveler agrees to reimburse Kior Travel within fourteen (14) days of written notice specifying the amount and nature of the charges. If Traveler fails to reimburse Kior Travel within this period, Traveler authorizes Kior Travel to charge the payment method on file for the documented amount, provided Kior Travel has first sent written notice of its intent to do so and allowed Traveler seven (7) days to respond. Traveler may dispute the charges in writing, and Kior Travel will not process the charge until the dispute is resolved, except where the Supplier has provided documentation substantiating the charges.

​

Travelers agree to bear the costs associated with recovering any unpaid fees or damages, including legal and debt collection fees.

​

If a Traveler decides against staying in the provided accommodations at any point during the Trip and arranges alternative lodging, they will not be eligible for refunds or discounts from Kior Travel. Furthermore, Kior Travel assumes no responsibility for issues arising from independently arranged accommodations and will not offer transportation to or from such locations.

 

AIR TRANSPORTATION

​

Kior Travel may research and recommend flight options on your behalf as part of Trip planning services. Kior Travel does not sell airline tickets. Any airline ticket purchase is a transaction between you and the airline or the booking platform through which the ticket is purchased. Your contract for air transportation is solely with the issuing airline, and Kior Travel is not a party to that contract. Kior Travel assumes no liability for any acts, omissions, or failures of airlines or booking platforms in connection with your air transportation.

​

Airlines frequently require immediate full payment upon booking. Purchased tickets may be non-refundable and non-transferable under airline policies. Policies vary between domestic and international routes regarding refund eligibility, advance check-in requirements, baggage allowances, and ancillary services. Airlines may modify these policies without notice.

​

Seat assignments depend on availability and remain subject to airline changes at any time. We cannot guarantee specific seating arrangements. Additional fees may apply for seat selection, baggage, meals, entertainment, and connectivity. Airlines may treat name corrections as cancellations triggering new purchases. You are responsible for confirming airline requirements, understanding applicable policies, and paying all associated fees.

​

You agree to follow airline safety protocols and release us from liability regarding airline operations, policies, or charges. We bear no responsibility for airline-imposed fees, equipment changes, schedule disruptions, weather delays, operational decisions, or other matters beyond our control.

 

TRAVELER CONDUCT

​

You accept responsibility for damages or losses your actions cause and agree to compensate affected parties, including us and third parties—fully.

​

We bear no responsibility for costs arising from Traveler behavior or removal from Travel Arrangements, regardless of whether removal results from negligence, misconduct, or other causes.

​

Any party providing Travel Arrangements may, at their discretion, deny service, require departure, or remove Travelers from transportation if they reasonably believe a Traveler poses danger, engages in disruptive or harmful behavior, or fails to follow instructions.

​

Travelers subject to such determinations may be left at any stop along the Trip, bear full responsibility for subsequent expenses, forfeit refund rights, and may not pursue claims against any involved party.

 

HEALTH AND PHYSICAL REQUIREMENTS

​

Some Trip activities may involve physical exertion, uneven terrain, altitude, or extended walking. Traveler is responsible for assessing their own fitness and ability to participate safely.

​

Traveler agrees to disclose to Kior Travel any medical condition, mobility limitation, or dietary restriction that may affect participation or require accommodation. Kior Travel is not liable for any injury or health issue arising from Traveler's failure to disclose relevant conditions or from Traveler's decision to participate in activities beyond their physical capability.

​

Accessibility and special requirements. If any Traveler requires accessibility accommodations, specialized assistance, or has medical needs requiring attention during travel, notify us before making Reservations. Suppliers may impose additional charges for equipment, have dimensional limitations for mobility devices, or require advance documentation for service animals. Accessibility standards, medical resource availability, and accommodation practices vary significantly across international destinations. Consult healthcare providers before planning travel. We will make reasonable efforts to communicate special requirements to Suppliers but cannot guarantee their ability or willingness to accommodate all needs.

​

Food sensitivities. Travelers with allergies or sensitivities that may cause harm during travel must notify us before Reservations are made. Such Travelers acknowledge heightened risk and bear sole responsibility for managing their conditions through all travel phases. We accept no liability for allergy-related harm under any circumstances.

​

Health emergencies. Illness or injury during travel is your responsibility to address. You bear all costs for medical care and alternative transportation arrangements. You may not delay or burden other Travelers or the Trip. You release us, Suppliers, and fellow travelers from liability for your health situation and any resulting travel disruptions.

 

HAZARDOUS ACTIVITIES

​

Travelers engaging in activities involving potential harm, whether to themselves, others, or property, do so at their own risk and discretion.

​

You assume all risks, costs, and liabilities associated with such activities. You release us from all related claims.

​

Hazardous activities include any pursuit reasonably regarded as inherently dangerous or potentially resulting in property damage, injury, illness, or death.

 

PERSONAL BELONGINGS

​

You bear sole responsibility for your luggage, possessions, and travel documents throughout your Trip. We accept no responsibility for damage, loss, delays, or other issues affecting your belongings.

 

TRAVEL DOCUMENTATION

​

International travel generally requires a passport valid at least six months beyond your return date.

Minors traveling without both parents may need additional documentation such as parental authorization letters.

​

Each Traveler must independently obtain all required entry documents, including but not limited to passports, visas, health certifications, well in advance, maintain current documentation, and understand entry requirements for all destinations.

​

We are not responsible for documentation failures or for verifying your documents meet jurisdictional requirements.

​

No refunds will be issued for travel prevented by documentation problems. Even complete documentation does not guarantee entry. Authorities may refuse admission for any reason, which will not justify refunds.

 

IDENTIFICATION REQUIREMENTS

​

TSA requires specific passenger data for air travel: legal name matching government identification, date of birth, gender, and redress number if applicable.

​

You bear responsibility for ensuring name accuracy across all Reservations and documents. Costs from name discrepancies or travel denial are yours alone.

​

Current security requirements appear at tsa.gov. Review before travel.

 

HEALTH ADVISORIES AND TRAVEL WARNINGS

​

You are responsible for monitoring and complying with all health-related travel requirements, including vaccination mandates, testing protocols, quarantine rules, and entry restrictions. You warrant ongoing review of CDC and State Department guidance for all destinations. Requirements change frequently, before, during, and after travel.

​

Destinations may require health documentation, testing, or quarantine. Compliance with local health protocols is mandatory. Non-compliance may result in denied boarding, service termination, or entry refusal—at your cost. Even full compliance does not guarantee entry. Refusal by any authority does not justify refunds.

 

CRIMINAL HISTORY

​

Some jurisdictions restrict or deny entry to individuals with criminal records or pending legal matters. As part of Trip planning, Kior Travel may ask you to disclose whether any member of your traveling party has a criminal history or legal restrictions that could affect entry into your destination country. This information is collected solely to advise you on destination feasibility and is not used for any other purpose. Disclosure is voluntary, but failure to disclose relevant information may result in denied entry, and Kior Travel bears no responsibility for entry refusals or related consequences.

 

PROHIBITED ITEMS

​

You are solely responsible for understanding and following all jurisdictional laws regarding restricted or illegal items, including but not limited to weapons, controlled substances, agricultural products, cultural artifacts, and hazardous materials.

Drug and medication laws vary dramatically between jurisdictions. Items legal in one location may carry severe penalties elsewhere. Carry prescription documentation.

Violations may result in immediate service termination and criminal prosecution.

 

HAZARDOUS MATERIALS

​

Federal law prohibits transporting hazardous materials aboard aircraft. Violations carry criminal penalties under 49 U.S.C. 5124.

​

Prohibited items include explosives, compressed gases, flammable materials, corrosives, radioactive materials, and lithium batteries with limited exceptions. Medical and toiletry items may qualify for limited exceptions.

​

Current restrictions appear at tsa.gov. Some international flights require cabin insecticide treatment; requirements appear at transportation.gov.

 

HANDLING YOUR PERSONAL DATA

​

Arranging travel requires sharing personal information, names, birthdates, identification numbers, payment details, and similar data with Suppliers and technology platforms facilitating your Reservations. By engaging our services, you authorize this information sharing.

We cannot control how third parties handle data once transmitted. We accept no liability for their data security practices or any breaches occurring outside our systems. We retain your information as long as necessary to serve you and fulfill legal and business requirements thereafter.

​

We comply with applicable privacy regulations, including GDPR and CCPA where relevant. You may request to access, correct, or delete personal data we maintain by contacting us directly.

 

MEDIA AND PROMOTIONAL USE

​

Unless you opt out in writing, each Traveler grants Kior Travel permission to use their name, photograph, voice, and likeness captured during any Trip for promotional purposes across websites, social platforms, and marketing materials, without compensation, territorial limitation, or time restriction.

​

You may opt out of media use by indicating your preference on the media consent form provided during booking, or by notifying Kior Travel in writing prior to departure. Opting out does not affect your eligibility to participate in the Trip. Please note that once media has been published, Kior Travel is not required to remove it.

 

PAYMENT DISPUTES

​

Dispute resolution before chargeback. If you believe any charge is incorrect or unauthorized, you agree to contact Kior Travel in writing at booking@kiortravel.com within fifteen (15) days of the charge and allow Kior Travel thirty (30) days to investigate and respond before initiating any chargeback, dispute, or payment reversal with your financial institution. This requirement does not apply to charges you believe are fraudulent.

If you initiate a chargeback or payment dispute for amounts properly due under these Terms and the dispute is resolved in Kior Travel's favor, you agree to reimburse Kior Travel for the disputed amount, any chargeback fees imposed by payment processors, and reasonable administrative costs incurred in responding to the dispute.

​

This provision does not limit rights under the Fair Credit Billing Act or other consumer protection laws.

​

This provision remains effective after Agreement termination.

 

FORCE MAJEURE

​

Neither you nor we will be held responsible for failing to meet our obligations under this Agreement when that failure results from circumstances beyond reasonable control (Force Majeure). This includes government actions or restrictions, natural disasters such as fires, floods, earthquakes, and severe storms, pandemics or widespread health emergencies, war, terrorism, civil unrest, or riots, labor strikes affecting airlines, transportation, or essential services, sudden border closures or travel bans, failures of utilities, communications, or infrastructure, and any cause to no fault of either party.

If something like this affects your Trip, we will let you know as soon as reasonably possible and explain how it impacts your travel plans. Once conditions allow, we will resume our services promptly.

​

When a Force Majeure event occurs, refunds depend on what we can recover from airlines, hotels, and other Suppliers. We cannot guarantee refunds for amounts that Suppliers refuse to return. If we need to rearrange your itinerary or cancel portions of your Trip because of a Force Majeure event, you are responsible for any additional costs associated with alternative arrangements, including new flights, extended accommodations, or changes to ground transportation.

We are not liable for losses, expenses, or inconveniences caused by events outside our control, and we will not be considered in breach of this Agreement for any delays or failures resulting from such events.

 

LIMITATION OF LIABILITY

We facilitate Travel Arrangements delivered by independent Suppliers outside our control. Suppliers bear sole responsibility for their offerings.

We make no guarantees. We disclaim all warranties—express or implied, regarding pricing, quality, safety, suitability, or availability of Travel Arrangements or our own services, which are provided "as is."

​

We accept no liability for harm arising from Supplier actions or failures, Traveler conduct, or third-party behavior including property damage, physical or emotional injury, death, inconvenience, delays, cancellations, insolvency, misrepresentations, or criminal acts.

​

To the maximum extent permitted by applicable law, Kior Travel's total liability to Traveler for any claims arising from or related to the Trip, this Agreement, or any services provided by Kior Travel shall not exceed the total amount paid by Traveler to Kior Travel for the Trip giving rise to the claim. This limitation applies regardless of the theory of liability contract—tort, strict liability, or otherwise—and even if Kior Travel has been advised of the possibility of such damages.

In no event shall Kior Travel be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost enjoyment, emotional distress, or costs of substitute travel arrangements, regardless of whether such damages were foreseeable.

This limitation does not apply to damages arising from Kior Travel's gross negligence, willful misconduct, or fraud.

This provision remains effective after Agreement termination.

 

INDEMNIFICATION

You agree to defend and hold harmless our Company, its principals, staff, contractors, and representatives from all third-party claims, damages, and expenses, including legal fees, arising from this Agreement, Travel Arrangements, or any Traveler's actions or failures.

This provision remains effective after Agreement termination.

 

GENERAL TERMS

Modifications. We may update this Agreement in writing. Oral statements cannot modify these terms. Material changes take effect thirty days after written notice. Administrative updates take effect upon website publication.

​

Assignment. You may not transfer rights or obligations without our written consent.

​

Waiver. Delayed enforcement does not waive rights. Waiving one right does not waive others. Rights are cumulative.

​

Severability. If any provision of this Agreement is held invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from this Agreement. The invalidity of any provision shall not affect the validity or enforceability of any other provision, and all remaining provisions shall continue in full force and effect.

Relationship. This Agreement creates no agency, partnership, joint venture, or employment relationship. You cannot bind us or create obligations on our behalf.

​

Discretion. Each Party may exercise discretion in its own interest while maintaining good faith.

Notices. Written notices are effective upon confirmed delivery to addresses provided under this Agreement.

​

Electronic Acceptance. Acceptance may occur via signature, electronic confirmation, click-through, or similar methods. All counterparts constitute a single agreement.

​

Conflicts. Supplier terms prevail over this Agreement. This Agreement prevails over supplementary contracts and Trip Documentation except where Trip-specific disclosures explicitly modify these terms.

​

Interpretation. Headings are non-substantive. "Including" is non-limiting. Neither Party is construed as drafter. All text is conspicuous.

​

Termination. We may terminate this Agreement and cancel Reservations upon payment failure, inaccurate information, material breach, or circumstances making performance impracticable. Termination by Traveler is permitted upon written notice, subject to cancellation policies herein. Termination does not release accrued obligations or surviving provisions.

​

Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.

​

Dispute Resolution. Parties will attempt informal resolution before litigation.

​

Jurisdiction. Any dispute arising from or relating to this Agreement or the Trip shall be brought exclusively in the state or federal courts located in New York County, New York, and Traveler consents to the personal jurisdiction of such courts. Neither Party will challenge venue. No class, representative, or collective actions are permitted.

​

Equitable Relief. Either Party may seek injunctive relief for threatened breaches.

​

Cooperation. Parties will perform acts necessary to effectuate this Agreement and address unforeseen issues in good faith.

​

Entire Agreement. This Agreement, together with the Trip Documentation and any Supplier terms incorporated by reference, constitutes the entire agreement between Traveler and Kior Travel regarding the Trip and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written. No modification of this Agreement shall be effective unless in writing and signed by an authorized representative of Kior Travel. No Kior Travel employee, agent, or representative is authorized to make any oral promises, representations, or commitments that are not contained in this Agreement or the Trip Documentation.

 

YOUR ACKNOWLEDGMENTS

By booking with us, you confirm the following:

You have carefully read and understood the payment, cancellation, Supplier, and refund terms provided to you. You agree to review all Trip Documentation promptly upon receipt and notify Kior Travel in writing within forty-eight (48) hours of any errors, omissions, or discrepancies.

​

You will contact us far enough in advance of your travel dates to ensure availability, avoid late booking fees, and minimize the risk of fare increases. You will make all deposits and final payments according to the schedule provided in your Trip Documentation. You will stay informed about travel advisories and entry requirements for your destination by regularly checking official government resources.

​

You have read and agree to these Terms and Conditions.
